There’s a step-by-step process that both parties need to follow. If either side doesn’t follow this process to the letter, they could end up owing significant money to the other party without anything to show for it. These steps include:

  • Find a property – a realty agent or attorney can help with this step.
  • Seller’s disclosure – the current owner of the property needs to disclose any issues they know about the land. This includes structural issues with the home, environmental damage, or crime committed on the property.
  • Make an offer – the buyer will make an offer on the home. This should be done in writing. The seller will either accept the offer or make a counter-offer.
  • Contract – after the seller accepts the buyer’s offer, they’ll both enter into a contract with one another. The contract will dictate the total price of the sale that includes a non-refundable deposit. The buyer must pay the deposit when they sign the contract. This deposit is non-refundable as long as neither party breaks the terms of the contract. The contract should include information like:
    • Closing date
    • Seller’s response time
    • Financing details
    • Accounting of all items included in the purchase
  • Inspection – a third-party home inspector will check the home for any previously-unknown damage.
  • Closing – at this point, as long as everything has gone according to the contract, the buyer will have the rest of their capital ready to buy the home. Once they sign final contracts and funding is exchanged, the seller will own the house.
